BOQ has double victory in Federal Court
Federal Court action by former property developer, and major Bank of Queensland business customer, Jacqueline Mulhern, to annul a sequestration of assets order made against her was dismissed yesterday by Justice Peter Jacobson, who described it as "without merit". Had Mulhern been successful, further legal action against BOQ was in train, with almost A$60 million in loans in dispute.This case was one in a long series of court appearances and appeals to government agencies made by Mulhern, along with her property developer husband and business partner, Richard Mulhern.Once Justice Jacobson's judgement was handed down, the representatives of both parties moved to another Federal courtroom, presided over by Justice Richard Edmonds. Mulhern's application to have BOQ return money and property worth tens of millions of dollars had been adjourned pending the outcome of the earlier court hearing, which, if successful, would have annulled Mulhern's bankruptcy.When he was informed that Justice Jacobson had dismissed the bankruptcy annulment application, Justice Richard Edmonds immediately dismissed the action before him, commenting that, in his view, Mulhern's bankruptcy status left her with no standing to continue with the case before him.Counsel for Mulhern argued that he had lodged submissions electronically proposing that two former directors of other Mulhern companies, Brian Murray and Wayne Kirkland, be added to the action.Justice Edmonds, however, refused the application, noting that extra applicants "cannot ride on the shoulders - or coat tails - of this application." That is, it remained open to the Mulherns to start fresh actions, but not at this time.
