Family business at Bill Express
The liquidator of failed payments company Bill Express is chasing explanations for more than $50 million worth of loans that Bill Express lent to related parties in the years between 2005 and 2008.Yesterday the liquidator's hearings in the Supreme Court of Victoria was told that, in addition to loans, Bill Express and the private companies associated with it made monthly cash payments to directors, paid for a car for the daughter of a director, the credit card bills of directors and executives, other car loans and possibly paid for the home of one executive's parents.All loans and payments were stopped when PPB (now liquidators of Bill Express) moved into the Bill Express building as corporate advisors in April 2008, counsel for PPB, Peter Bick said."On the 28th of April 2008, PPB were appointed by the board and all the funny business stopped. Do you accept that?" Bick asked Sandro Di Donato, the owner of APN, a private company associated with the Bill Express group."I don't know, I wasn't involved," answered Di Donato.Di Donato denied that he had signed a loan document presented to him in court that carried his own signature."That is an electronic signature," said Di Donato when shown one such document, "You can see the pixellation on the signature."Di Donato said he didn't know who had access to an electronic version of his signature.As Bill Express struggled to stave off creditors in 2007 and the early months of 2008, a number of elaborate funding deals were hatched by Bill Express directors.One of the key directors, Hal Christiansen, was allegedly working on a deal with US based financiers that involved 43 pension funds and was worth €800 million to Bill Express, according to copies of emails presented to the court by Bick."This is the closest we have ever been," wrote Hal Christiansen to six fellow directors and executives about the deal.Bick asked Di Donato to explain what Christiansen (who died in July 2008) was talking about."I have no idea," said Di Donato, who has previously told the court he has known and worked with the Christiansens and Bill Express' former executive director Julian Little since the early 1990s."Christiansen refers to 'we', Mr Di Donato, you are included in that group," said Bick, "What is he talking about?""I don't know," said Di Donato."This was some sort of scam wasn't it Mr Di Donato?""I have no idea.""This reads like one of those fraudulent emails from Nigeria," said Bick. "What were you trying to achieve?""I can't comment," replied Di Donato.
