Fees class action gets first date with High Court
Lawyers managing the litigation for ANZ customers over the alleged overcharging of common bank fees have obtained a date for a first hearing in the High Court following an adverse Federal Court ruling last month.The High Court of Australia will hear a leave application for an appeal on the ANZ fees class action on February 6. Law firm Maurice Blackburn told the Compliance Complete service of Thomson Reuters Accelus that the firm had applied to move the action straight to the High Court as this would save time and money by bypassing the full court appeal process in the Federal Court.In December, Justice Michelle Gordon ruled that 13 of the 17 dishonour and overlimit fees "are not capable of being characterised as a penalty". However, she found late payment fees for credit cards were "capable of being characterised as a penalty".Around 38,000 ANZ customers are taking part in the class action. Last month, the law firm late also launched separate Federal Court proceedings against Citibank, Commonwealth Bank, National Australia Bank and Westpac on similar grounds to those of the ANZ action.
