FOS modifies changes to terms of reference
After assessing stakeholder feedback the Financial Ombudsman Service has decided not to proceed with several proposed changes to its terms of reference.In an update on the consultation, FOS said it would not index monetary limits and compensation caps. It will defer a plan to introduce a "per month" jurisdictional limit when dealing with income stream insurance claim disputes.It will proceed with changes allowing it to have jurisdiction over financial services disputes involving accountants but it will exclude traditional accounting services from coverage.FOS has been in renovation mode for most of this year after a review of its operations, published in March, called for the dispute resolution body to improve its efficiency.In July, it issued a consultation paper outlining proposed changes, including a streamlined dispute lodgement process, quicker timeframes for dispute resolution and the earlier introduction of expert decision-makers into the process.FOS plans to create a separate class of decision-maker within the organisation, to be known as adjudicators, to manage simple low-value disputes.It is also introducing a streamlined one-step dispute lodgement processIt will exclude small business disputes involving credit facilities exceeding A$2 million. It said: "Businesses that have access to these large credit facilities are often well resourced and in a position to pursue a dispute in more traditional forums."It will also change its approach to a number of other types of disputes, such as those involving trust companies, small business insurance disputes, and uninsured third party motor vehicle disputes.FOS said stakeholders supported key changes, including streamlined lodgements and procedures, the appointment of adjudicators and the $2 million small business exclusion.The update also outlined an additional change to its terms of reference. It will introduce a rule allowing it to bring a second financial service provider into a dispute in a more efficient way.
