Judge questions Westpac's handling of employee class action
A class action against Westpac brought by former St George Bank staff over allegedly unpaid incentives is grinding its way through the courts, with a ruling earlier this month on the extent of discovery in the case.A former employee is claiming in a representative action (Neil Younger & Ors v Westpac Banking Corporation) that Westpac should be ordered to pay a "retention incentive" that St George Bank allegedly offered key staff if they remained in their jobs during the merger with Westpac in 2008.According to a report in Workplace Express, a hearing was abandoned in April after Westpac failed to comply with a discovery order.Earlier this month the parties were back in court arguing about the extent of discovery. Westpac sought a qualification to omit some categories of information, claiming that without the qualification it would cost A$70,000 to restore the 250,000 documents sought.Justice Peter Garling agreed to limit the discovery but he also noted that the case was relatively straightforward and it was not clear why it was taking so long.He also noted Westpac's failure to attend to its obligations at the time the orders for discovery were made.
