Pregnant CBA exec cleared to sue over dismissal
A sacked Commonwealth Bank manager will be able to continue with a claim for unfair dismissal centred on the relevance of her pregnancy to the decision.Lara Adams, an executive manager for group strategic initiatives, received her marching orders in May 2015, two days after advising her superior, Christopher Russell, of her new circumstances.A ruling of the Fair Work Commission, released on Friday, relates that on the day of her dismissal, Russell said to her words to the effect: "Your performance is unacceptable. Your coaching of 'Green Belts' has not been good. You are not delivering. "You say you have a 'Black Belt Certification' and it was provided to HR but they have no record of it. You've failed to produce a copy. This is not acceptable and I'm terminating your employment forthwith."Green Belts and Black Belt Certification relate to facets of the six sigma project methodology, a popular management technique.In two earlier performance reviews Russell rated Adams as making a "valued contribution" and "tracking well" against her KPIs.In the second of these Russell said Adams "possesses strong project management experience and skills with a strong bias towards execution and implementation [and] possesses deep commitment to deliver high-quality outcomes and holds herself to extremely high standards."The FWC ruling did not consider the merits of the matter but rather turned on the technicalities of Adams' eligibility to bring a case and a delay in doing so.
